New podcast from the National Constitution Center on “Marijuana and the Constitution”

Earlier this week, I had the great honor and pleasure of talking with Jeffrey Rosen and Randy Barnett as part of the National Constitution Center’s “We the People” series concerning various constitutional issues related to the regulation and legalization of marijuana. Marijuana was first outlawed nationally by the Marijuana Tax Act in 1937. Since 1970, it has been classified an illegal Schedule 1 drug under the Controlled Substances Act, listed alongside LSD, heroin, and other narcotics.

But in 1996, California became the first state to allow the use of marijuana for medical purposes, starting a cascade of changes at the state level. As of May 2016, 24 states and D.C. have legalized medical marijuana; four states — Colorado, Washington, Oregon, Alaska—and D.C. have also legalized recreational marijuana. In November 2016, more states, including Nevada and Maine, are slated to vote on the issue.
